Maryland Creates Infused Pouch Category

Maryland finalized regulations establishing sublingual pouches as a specific regulated product category.

The rules were adopted August 13, published in the September 4 Maryland Register and take effect September 14.

This isn’t simply a loose definition buried in guidance.

Maryland defines a pouch as a permeable sachet containing concentrate designed to dissolve in the mouth and be absorbed buccally or sublingually.

Unless regulators specifically authorize otherwise, limits are:

10 mg THC per serving and 100 mg THC per package.

The pouch itself must carry Maryland’s universal symbol, or be individually wrapped with the symbol if direct marking isn’t practical. Packaging must also warn that the pouches are not intended to be heated, burned or swallowed.
